RACE DISCRIMINATION

Both, State and Federal laws prohibit discrimination in the terms or conditions of employment on the basis of a person’s race or color. This includes, discrimination in pay, title, hours, vacations, and most everything else, including whether or not a person is hired, terminated, or promoted. It is also against the law to discriminate based on association with people of a particular race.

 

There are two types of race discrimination in the workplace: “disparate treatment” and “disparate impact”.  “Disparate treatment” is straightforward discrimination. For example, treating a person differently because of a protected class, like national origin, religion, sex or race.  Disparate Impact Discrimination the company policy excludes certain individuals from certain jobs, positions, or from promotions.  This is the case even if the policy was not actually designed to exclude these individuals, but nevertheless resulted in that outcome.
